Land Rental Contract

Today´s star question at the Law Firm:

Is it the rental contract of my plot of land ( whose tenant has developed into turning it into a great business) submitted to obligatory by Law clauses or do the free will principle works here? Contract´s deadline is being met on next Septermber 201. Can he impose an obligatory continuation on me?

Article 1255

Parties can establish all pacts, clausules and conditions they consider as convenient, always they are not against Law, Moral ort Public Order.

Los contratantes pueden establecer los pactos, cláusulas y condiciones que tengan por conveniente, siempre que no sean contrarios a las leyes, a la moral, ni al orden público.

So the tenant, after the agreed contract period, cannot impose to you continuation or whatever condition unless he proved something which was agreed on the contract for this obligatory extension has happened:

4º. CARGAS Y SITUACION POSESORIA DE LA FINCA.-El arrendador declara bajo su personal responsabilidad que la finca objeto de arriendo se encuentra libre de cargas, gravámenes y arrendamientos. Y,
